Bethesda Denied Block on Interplay’s Fallout Production

Gamasutra reported that a court has denied Fallout 3 creator Bethesda a block on the developer Interplay from working on an MMO based on the Fallout series. The original suit filed in September of this year contested Interplay’s sale of the original Fallout games, as well as delays to the online version.
Bethesda bought the Fallout franchise in 2007 from Interplay (the original developers of Fallout) and then licensed it back to Interplay to enable them create the Fallout MMO. Bethesda claim that Interplay have not kept with the obligations that were part of that deal, namely taking too long for production to start.
However due to the court’s ruling Interplay is free to continue developing the game with Bethesda still looking to regain the license. In the original agreement, both parties had stated that production for the Fallout MMO would begin by April 2009. Bethesda claimed that this was not upheld. The ruling also enables Interplay to continue selling the original Fallout titles in a bundle, which Bethesda stated was confusing to consumers as it had the same name as Fallout 3.
No reasons were released regarding the court’s decision, making it hard to figure out what has gone on, but it remains that Interplay can continue work on the Fallout MMO, of which little is known. It seems Interplay have managed to convince the judge that they haven’t breached their contract with Bethesda. We’ll see if anything else emerges as to why the injunction was denied, and who knows, perhaps we’ll actually see a Fallout MMO sometime soon.


I haven’t really been following this much but I will say the Interplay bundle may confuse some people. It’s called the “Fallout Trilogy” bundle and has Fallout 1 & 2 and Fallout Tactics.
For people new to the series they may see this and think they are getting Fallout 1, 2 & 3. Fallout Tactics was a pretty obscure title and I can see people finding this bundle and picking it up simply because they think they are getting Fallout 3 with an added bonus of 1 & 2 for a cheap price.
Though I guess it’s their own damn fault if the only thing they read on the package before buying it is the bundle title.
